that? Pardoning someone for a crime makes total sense. But preemptively pardoning? THAT doesn’t seem right at all. It’s a bastardization of the pardon power.
SCOTUS will almost for sure have to get involved, here. The Presidential pardon power has few limits. But there is not even a charge, here! How do you pardon when there is no crime charged?
If that is OK, couldn’t a President unilaterally declare that any illegal alien also be preemptively pardoned? So national policy can be altered without Congress being at all involved? Should every President issue a blanket pardon for everyone somehow attached to him?
This just makes no sense at all. I don’t see how Biden can make it stick.
The ONLY silver lining is that now there IS no way to assert the right to remain silent: YOU are not in legal jeopardy! And if they lie, they can go to jail…
