Let’s say a business passed over person because he was white and male, hiring a less-qualified female minority (See: Ketanji Brown Jackson). How much in punitive damages do you think that a judge might award him?
The issue is that I don’t believe that this discrimination can legally hold up. There will be some companies that get hit very hard because of this. And, indeed, that should be the case! It seems pretty simple: You may not discriminate on the basis of gender, religion, or skin color!
