See, this is
a HUGE problem for the court (sorry this is a bit long). Here’s what it means:
Lefties, over the last 20 years or so, have adopted the iron-clad rule that they never engage in logical argument. ANY argument means that one’s position is at risk, and Leftism just cannot bear logical scrutiny so all logical debate is avoided. You can’t be wrong if you never argue!
No questions! You must be “born” a dyed-in-the-wool Lefty (whatever today’s position is).
But this Lefty ethos of avoiding debate has now insidiously seeped into the supreme court. In the past, a draft decision was crafted and then the justices debated it among themselves, coming to a decision. Justices could hear the reasoning of the other side, and might indeed be swayed.
But if the draft opinion is leaked, any change is extremely unlikely to occur. You have people on the sidelines who really don’t want anything but to get their own way entirely, stoking the conflict, saying, You gonna take that?
So no debate. No reasoned argument. No possibility of change.
SCOTUS then becomes, not a deliberative body, but a mini-congress. Most positions are decided WELL before any evidence is actually heard! Certainly any major decision.
I’ve heard Lefties superciliously bemoaning the increased polarization and intransigence of positions, yet they seem oblivious to the fact that their own refusal to engage in persuasion is the root cause of this polarization!
And that polarization is crucial to Leftism. You must have the “correct” opinion and never even (honestly) consider any other.
Yes, this leaking is an extension of the Lefty polarization and refusal to engage in debate. Absolutely, Lefties, polarization is a problem. But understand well that YOU are at the root of this problem–don’t try and fob it off on others!
Let’s not get overconfident. Still…

New polling provided to Secrets Monday showed that 84% want voter ID, and huge percentages of black and Hispanic voters are behind the surge in support as the nation readies for the fall congressional midterm elections.
I think for the Democrats, opposing voter ID is both nonsensical (IF you want fairness) and grossly self-serving. It is simply a dog that don’t hunt. If you want free and fair elections, that is.
It is a position bereft of common sense, and is HUGELY unpopular with normal people. Because they see it for what it is–a Lefty boondoggle tailored to make it easier for the Left to steal elections.
It’s the same as with “motor-voter” and all stripes of “non-disabled people voting by mail” schemes. And I think even those have a tenuous hold right now. Several states have recently rightfully rejected such schemes.
The Left wants to wrap itself in the flag of “Democracy” in order to obtain their nefarious goals. And indeed, some are fooled. But that is just putting a happy face mask on the gaping maw of Hell. It’s a ruse.
You know, like the direct election of Senators! It is a “whited sepulcher,” beautiful on the outside but actually full of dead men’s bones and all manner of impurity. THIS is the Left in a nutshell!

doth evil mar. And it is starting to become more and more likely that this totally unethical leak of Dobbs will actually HARM the abortophiles in the long run. Even in the medium-run..
Still, I think the penultimate paragraph in Part IV provides the course of action going forward:
We do not pretend to know how our political system or society will respond to today’s decision overruling Roe and Casey. And even if we could foresee what will happen, we would have no authority to let that knowledge influence our decision. We can only do our job, which is to interpret the law, apply longstanding principles of stare decisis, and decide this case accordingly.
In a perverse way, due to the leak, the Court can foresee what will happen when the opinion is formally released. Turn on MSNBC and log onto Twitter. We know exactly what would happen. Still, that foresight should be irrelevant. The justices lacks “authority to let that knowledge influence [their] decision.” Let the press do their job. And the Justices can will do their job.
I also think that rather than weakening positions, it actually solidifies them. Who would want to be known as “that pansy who crumped and tailored their jurisprudence to a certain sect after having once taken a stand?” The justice who does so rightly is tarred with, “I have principles, and if you don’t like those I have others…”
So will this gambit prevail? I doubt it.
It’s well passed time for this stupid national fight to be over. Let every state decide for themselves. Let the people’s voice be heard!
